Illegal fence height and material. Attached is Oakland fence code. I provided building code below. 1. Fence Height & Zoning Code Sections Maximum Exempt Height (Up to 42 Inches): Under OMC Section 17.108.140 (Residential Zones and Facilities), any fence, barrier, or freestanding wall up to 42 inches (3.5 feet) in height in a front yard or street-side yard is exempt from planning approval. Permitted Range with Review (42 Inches to 6 Feet): Fences taller than 42 inches but not exceeding 6 feet in a front or street-side yard require Zoning Approval via Small Project Design Review pursuant to Section 17.108.140. Building Permit Threshold: Under Oakland's building construction guidelines, wood or metal fences/freestanding walls do not require a separate building permit unless they exceed 7 feet in height (though front yard zoning caps you at 6 feet max without a variance). 2. Transparency & Setback Regulations Transparency Rule (60% Open View): For any front yard fence approved between 42 inches and 6 feet, Oakland planning guidelines require the structure to be at least 60% transparent (such as open picket, wrought iron, or tubular steel) to maintain neighborhood sightlines. Sidewalk Setback Requirements: Front yard fences generally must be set back at least 18 inches from the property line/sidewalk interface
